
LEGAL REMEDIES AGAINST CANCER DRUGS NOT COVERED BY THE SOCIAL SECURITY INSTITUTION (SGK) AND THE HEALTH IMPLEMENTATION COMMUNIQUÉ
The fact that a drug is not included in the SUT list does not necessarily mean that the Institution will not cover its cost under any circumstances. However, in such cases, a legal process must be initiated to request reimbursement. Even if the drug in use is not listed, the patient may apply to the Social Security Institution (SGK), and if the application is rejected, a lawsuit against SGK may be filed with a request for an interim injunction.
